Monthly-paid workers get 15 days' wage for each of the first five years and one month's wage for each later year, pro-rata, capped at one and a half years' wage (Article 51(b)). Workers paid by the day, week, hour or piece get 10 days and 15 days, capped at one year's wage (Article 51(a)).

The wage is the basic salary plus allowances and other amounts paid regularly (Article 55). The daily wage is usually monthly wage ÷ 26 because the law assumes a six-day week; employers that divide by 30 produce a lower number.

On an open-ended contract a worker who resigns gets nothing under 3 years, half after 3 to 5 years, two thirds after 5 to 10 years and the full indemnity after 10 years. The cap is applied first and the fraction after. The full indemnity is due when the employer ends the contract, when a fixed-term contract expires, and in Article 52 cases such as a female worker resigning within a year of marriage.

Rules were checked against these sources in October 2026. Laws change — if a source says something different, the source is right.

How is indemnity calculated in Kuwait?

15 days' wage per year for the first 5 years and one month per year after that, on your last full wage, pro-rata, up to 18 months' wage.

Do I get indemnity if I resign before 3 years?

Not on an open-ended contract — Article 53 gives nothing for less than 3 years when you resign.

Why divide by 26?

Kuwait's law is built on a six-day working week, so a month has 26 paid working days. Dividing by 30 reduces the indemnity by about 13%.

Are allowances included?

Yes, regular allowances form part of the wage (Article 55). The social and children allowances paid to Kuwaitis are excluded.
