A full-time expatriate worker who completes at least one year of continuous service gets 21 days of basic wage for each of the first five years and 30 days for each year after that. Part years count pro-rata once the first year is complete, days of unpaid absence are left out of the service period, and the total can never be more than two years' wage (Article 51).
Only the last basic salary counts — housing, transport, phone and other allowances are not included. Since the 2021 law came into force on 2 February 2022, resigning no longer reduces gratuity and the old limited/unlimited contract distinction does not change the formula.
The law does not define a daily-rate formula for gratuity. The DMCC free zone's published example uses basic × 12 ÷ 365 (AED 10,000 → AED 328.77 per day), which this calculator uses by default. Many employers and online tools use basic ÷ 30, which gives a slightly higher figure. Switch the method to compare both — the difference for AED 10,000 over 4 years 3 months is about AED 410.
UAE nationals are covered by the pensions law. Federal government employees have their own HR law. DIFC employees are in the DEWS savings plan and ADGM has its own Employment Regulations. Employers who joined the MOHRE Savings Scheme pay 5.83% (under 5 years) or 8.33% of basic salary into a fund instead of gratuity for enrolled periods. Part-time workers get the same formula multiplied by their contract hours ÷ full-time hours (Cabinet Resolution 1 of 2022, Article 30).

How much gratuity do I get after 5 years in the UAE?
With 5 full years you get 21 days × 5 = 105 days of basic wage. For a basic salary of AED 10,000 that is about AED 34,520 using basic × 12 ÷ 365 as the daily rate.
Do I get gratuity if I resign in the UAE?
Yes. Under Federal Decree-Law 33 of 2021 resignation does not reduce gratuity, as long as you completed at least one year of continuous service.
Is gratuity calculated on basic or gross salary?
On the last basic salary only. Allowances such as housing and transport are excluded.
Do I get gratuity for less than 1 year?
No. A worker with less than one year of continuous service is not entitled to gratuity. After one year, part years are paid pro-rata.
Is there a maximum gratuity?
Yes. The total cannot exceed two years' wage — 24 months of basic salary.
When must the employer pay?
Within 14 days of the end of the contract, together with other dues (Article 53). The employer may deduct amounts you owe.
